1. A client who comes to my office who is married to a U.S. Citizen spouse, but my client is a conditional resident alien, meaning that my client was granted a two-year period of permanent resident status based on a qualifying marriage to a U.S. Citizen. My client may be at risk for deportation if divorced in Michigan.
2. If my client and their spouse signed an affidavit of support, which is an agreement to support an intending immigrant and spouse of children immigrating with him or her and to reimburse the government that provided the sponsored immigrant with public benefits. A Michigan divorce does not terminate this obligation. This affidavit will be important for figuring out spousal and child support.
3. If my client is a non-U.S. citizen and there are allegations of domestic violence or other qualifying offenses, the immigration status of that client could be in jeopardy.
